Scholars have differed concerning the ruling on one who swears by deeming something unlawful (ḥarām) and states it generally in his oath: According to the Malikis, his wife is divorced if the vowed-upon event occurs, unless he excluded her by his intention. According to the Hanbalis, he is obligated to offer the expiation for ẓihār. Some of them are of the view that divorce is binding if he intended it. According to the Hanafis, the wife does not fall under this prohibition except with intention.
