What is the ruling on stipulating a minimum profit of two thousand Saudi Riyals, if 10% of the sales is less than this amount, knowing that the profit does not exceed 10% of the sales, regardless of the amount?

This company is not permissible in Islamic law because it is based on setting a fixed profit amount for one of the partners and guaranteeing that profit in all circumstances, such as one partner committing to pay a fixed monthly amount of no less than two thousand riyals to the other. This makes the partnership forbidden. A sound partnership is based on both partners bearing profit and loss. If one partner guarantees profit always, then the partnership is invalid. The correction of the partnership would be for both parties to contribute with their money and effort, or for one of them to contribute with money and the other with effort, provided that the money is cash or assets valued as cash at the beginning of the partnership. Then they agree on a common profit percentage for each of them, and they bear the loss just as they share in the profit.
