What is the ruling on proposing to a girl who has had her marriage contract (aqd qiran) solemnized but has not yet consummated the marriage, knowing that she did not agree to this marriage and desires another person who has proposed to her?

It is not permissible to propose to a married woman, or to allude to proposing to her, or to establish a relationship with her. Rather, one must immediately turn away from her. This is because a relationship between a man and a woman in general is forbidden, and the prohibition intensifies if the woman is married, as it constitutes an aggression against the husband's right and an act of corrupting his wife against him. The Prophet, peace and blessings be upon him, said: "He is not one of us who corrupts a woman against her husband."

Divorce is solely in the hands of the husband and no one else. It is not permissible for anyone to strive to separate a married couple, unless the husband wishes to divorce her, or she seeks a Khul' from him for a legitimate reason. In such cases, it is permissible for a man to then propose to marry her.
