Disputes and contentious issues must be presented to the Sharia courts or their equivalent, or orally conveyed to scholars so they can hear both parties to the dispute. A judgment cannot be made based solely on a claim without evidence or admission, as the Prophet, peace and blessings be upon him, said: "Were people to be given according to their claims, men would claim the blood and wealth of others. But the burden of proof is on the claimant, and the oath is on the one who denies." If a right is established and its owner cannot obtain it except through a legitimate stratagem, then there is no harm in that.
