Are the spouses considered divorced by three, and what is the ruling on their return to each other, especially since the wife is coming to live with the husband, and is a new contract and a new dowry required?

If the Shaykh from whom the fatwa is sought is trustworthy in religion and knowledge, and he has been informed of the reality as it is, then act upon what he has given you as a fatwa, without seeking opinions from multiple muftis. Explicit divorce occurs merely by the husband uttering it; it is not a condition for the wife to know, nor for him to utter it in front of her. Anger does not prevent divorce from occurring unless the person is unaware of what he is saying. If the waiting period (iddah) of a revocable divorce ends, the woman becomes irrevocably separated by a minor separation (baynunah sughra), and she is not permissible for her husband except with a new contract. The absent husband can appoint someone to act on his behalf in the contract.
