How is the inheritance of a four-story house calculated, given that there are five sons and two daughters from both parents, and another sole daughter from the mother from a different husband, knowing that the mother bought the land from her inheritance, the father built the first floor, and three of the sons built apartments at their own expense and reside in them, and after the father's death, the mother wants to distribute the inheritance?

The deceased's sons and two daughters inherit according to the rule: "to the male, a portion equal to that of two females." As for the land owned by the wife, upon which the husband built with her consent, there are two possibilities: The first is that the permission to build was a loan [of use], which becomes void upon death, and the wife takes the building after paying its dismantled value to the heirs. The second is that the permission was with the intention of partnership, in which case the husband is a partner in the property in proportion to what he contributed. As for the apartments built by the children, their ruling differs according to the contract concluded between them and their parents. If it was an explicit gift, then the building belongs to them; otherwise, it is a loan [of use]. It is advisable to consult scholars or the Sharia court for such matters.
