How can a wife be divorced from an oath of triple divorce after attending wedding parties?

1 min readAlso available in العربية

The majority of scholars are of the opinion that swearing by divorce results in the occurrence of divorce upon breaking the oath, and this is the fatwa we adhere to. Some scholars, like Ibn Taymiyyah, are of the view that its ruling is similar to swearing by Allah, thus requiring an expiation for an oath (kaffarat yamin) and the divorce does not occur if the intention was not to make the divorce conditional.

So, if the wife attends the wedding party, her divorce occurs. If he swore using the phrase "triple divorce," three divorces occur according to the majority. However, if he swore using the word "divorce" and repeated it three times without intending to repeat the divorce itself, then only one divorce occurs.

If it was a single oath, the husband can reconcile with his wife during her 'iddah (waiting period) after she attends the wedding, and the oath is dissolved. However, if it was a triple oath, the husband has no way to reverse it while keeping his wife under his marital bond. Thus, either the wife refrains from attending weddings, or she becomes irrevocably divorced from him (baynunah kubra).

The permissible oath is by Allah Almighty, and swearing by divorce is among the oaths of the dissolute and has grave consequences.
