What is the ruling on commuting the sentence or acquitting a defendant if the sentence is more severe than what the the law stipulates, and the state government has not considered the Sharia prescribed punishment?
It is not permissible to defend criminals to acquit them or to reduce their sentence, unless the sentence is more severe than what they deserve Islamically, due to the Almighty’s saying: "And do not be an advocate for the traitors" and "Indeed, Allah enjoins justice and good conduct." And due to the Prophet's saying, peace and blessings be upon him: "Whoever disputes in falsehood while knowing it, remains in Allah's wrath until he abandons it."
