There is no validity to the uncles waiving their share of your father's house during his lifetime. Rather, a valid waiver occurs after his death. If they waive their share while they are adult and of sound mind, there is no harm. If the contractor stops construction and you cannot compel him, the existing apartments and those already sold must be divided among all the heirs.
