Does the wife get divorced if she opens her husband's new phone, knowing that he conditioned her divorce on her opening his old phone?

A man's statement to his wife, "If you touch the phone, you are divorced," depends on his intention. If he intended to prevent her from touching it and did not intend divorce, then this is an oath, and he must pay an expiation for an oath (kaffarat yamin) if she touches it. But if he intended divorce, then a divorce (talaq) occurs if she touches it. Similarly, his intention regarding "the phone" must be considered: did he mean a specific phone, or any phone belonging to him?
