What is the ruling on the marriage of a man to a Colombian Muslim woman, where their marriage contract was officiated by a guardian and a mazoun from the Habashis, knowing that she embraced Islam after the marriage, and the two witnesses were from Ahl al-Sunnah wal-Jama’ah?

For a marriage to a Kitabiyyah (a woman from the People of the Book) to be valid, it is a condition that it be with the permission of her guardian (wali) from her own faith. If she has no guardian, then some scholars say her bishops may give her in marriage, or the Muslim judge (Qadi), or whoever acts in his stead according to others. Marriage without the guardianship of a man other than her wali is invalid due to the absence of the guardian condition.

Given that this marriage has already endured for a long time, some scholars believe there is no harm in continuing with it, as stated in "Al-Fawakih Ad-Dawani" by An-Nafrawi Al-Maliki. However, if you wish to be more cautious by renewing the contract with all conditions fulfilled, that would be a good thing.
