Does the action taken by the authorized marriage official of writing and reading the contract, then asking the guardian and the husband for acceptance using the phrase "yes," constitute a valid dictation (talqeen) for the offer and acceptance in the marriage contract?

Offer and acceptance are two fundamental pillars of the marriage contract. Merely reciting them and agreeing to them verbally or in writing is not sufficient without the guardian and the husband uttering the prescribed legal formula. If either of these pillars is absent, the contract is considered void and must be renewed with its prescribed legal formula, along with repentance to Allah. It is incumbent upon a Muslim to inquire about Sharia rulings before undertaking any action, especially in matters of marriage.
