Is the presence of the husband required with the bride's guardian at the marriage contract, or is the offer and acceptance in the presence of his family sufficient for the validity of the contract? Is their joint presence required before the ma’dhun (authorized marriage official) to document the contract? And what is the validity of a contract in which the husband and the girl signed the contract before the ma’dhun without the presence of her guardian, after his approval?

It is permissible to delegate in the marriage contract. Therefore, it is valid for a man to appoint his family as agents for this purpose with his knowledge and consent, and the contract is valid even if the husband does not attend the session. This is supported by the fact that the Prophet, peace and blessings be upon him, appointed an agent to accept marriage on his behalf, and necessity may sometimes call for this. Similarly, it is permissible for a father to conclude the marriage contract for his son if the adult son appoints him as an agent, and the marriage is valid if it fulfills its pillars and conditions and there are no impediments.
