The majority of jurists hold that repentance from fornication is not a condition for the validity of marriage to a fornicator (male or female). The Hanbalis, however, disagreed, stipulating repentance and the completion of the waiting period ('iddah). The more preferable view is that of the Hanbalis. Those who stipulate repentance differed on three points: the waiting period of the female fornicator, whether the prohibition includes the male fornicator or only the female fornicator, and whether the prohibition is temporary or permanent.
