Divorce pronounced during menstruation is valid, despite being an innovative (bid'i) divorce according to most scholars, and this is the prevalent fatwa. Therefore, the wife becomes irrevocably divorced (baynunah kubra) and is not permissible for her husband unless she marries another man and he consummates the marriage with her, and then he divorces her or dies, and her 'iddah (waiting period) from him ends.
