Is a threefold divorce inflicted upon the wife if she enters her husband's land after his saying to her: "By threefold divorce, you will not have for me a grain of soil," and how can the wife return to him while remaining in her family's home?

The way to avoid the occurrence of a divorce suspended on the wife entering a specific land is for her not to enter it. If she enters it in the manner intended by the husband, a triple divorce occurs according to the majority of scholars, and she becomes unlawful for him until she marries another husband in a marriage of desire.

If the husband intended to specify a duration or a particular manner, or if the oath had a specific context, then the oath might not be broken.

Shaykh al-Islam Ibn Taymiyyah and those who agreed with him said: If the husband intended to threaten or prevent and did not intend divorce, then only an expiation for an oath is due from him. But if he intended divorce, then a single divorce is due from him, and he has the right to take his wife back before the completion of her iddah if this divorce does not complete the count of three.
