Is this marriage considered legitimate, and is it permissible for another man to propose to her and marry her before her divorce?

If the marriage was without a guardian (wali) or witnesses, it is invalid (batil). The woman must observe an iddah (waiting period) of three menstrual cycles if she is not pregnant, or by giving birth if she is pregnant. She is permitted to marry after her iddah concludes.
