What is the ruling on swearing by triple divorce with the intention of expressing annoyance, and does it take effect if one intends to restrict it to a place or persons, and how can one be released from it, and what are the consequences for the wife if she speaks about the matter that the husband swore not to speak about?

The majority of scholars hold that swearing by divorce [talaq] brings about divorce upon breaking the oath, and that pronouncing divorce three times results in three divorces. Some scholars, like Ibn Taymiyyah, are of the opinion that swearing by divorce, when the intention is not to effect divorce, is treated like an oath by Allah, requiring an expiation for an oath (kaffarat yameen) if broken, and no divorce occurs. Furthermore, when intending divorce by pronouncing it three times, only one divorce occurs. The fatwa issued [mufta bihi] is that three divorces occur, resulting in a major, irrevocable divorce [baynunah kubra]. However, according to Ibn Taymiyyah's view, no divorce occurs, and an expiation for an oath is due. It is advisable to present the matter to trustworthy scholars.
