If the killing was accidental and the victim's guardians (awliya') waived the blood money (diyyah), then the driver's responsibility is absolved by performing the expiation (). If he does not perform it before his death, it should be paid from his inheritance, or his guardians are encouraged to pay it on his behalf, based on the : "Allah's debt is more worthy of being fulfilled." The expiation is freeing a believing slave; if none is found, then fasting for two consecutive months.
