The question

What should I do about the behavior of my 13-year-old brother-in-law, who suffers from serious behavioral problems such as stealing, swearing, staying out late, and associating with bad company, especially since his mother refuses to intervene or administer corporal punishment under the pretext that he is an orphan, and his condition is worsening?

The answer

Islam has commanded parents to properly raise their children, and the disciplining of an orphan is like the disciplining of any other child. When Aisha was asked about disciplining an orphan, she said: "Indeed, I would hit one of them until he straightened up." A man asked Sa'id ibn al-Musayyab: "What should a man hit his orphan for?" He replied: "What a man hits his own child for."

As for the wife going to her parents' house for a legitimate purpose, such as maintaining kinship ties, there is no harm in it. However, she must ensure that she is not exposed to the gaze of her brother's friends. The husband should advise the mother of the child and explain the harm of her silence regarding her child's behavior.

If the wife's going away leads to corruption or discord, then the husband has the right to prevent her, and she must obey, based on the words of Allah Almighty: "O you who have believed, protect yourselves and your families from a Fire whose fuel is people and stones" [At-Tahrim: 6], and His saying: "And cooperate in righteousness and piety, but do not cooperate in sin and aggression" [Al-Ma'idah: 2].
