Is the Hadd (prescribed punishment) to be carried out on one who kills a person who entered his house or land and did not leave after being warned, knowing that the Messenger of Allah, may Allah’s prayers and peace be upon him, said: "If you fight, then if you kill, you are in Paradise, and if you are killed, you are in Hell"?

Umar ibn al-Khattab, may Allah be pleased with him, ruled for retribution (qisas) against the Bedouin who killed the old man. This ruling was in accordance with Islamic law because the Bedouin admitted to killing the old man, who had killed the Bedouin's prized camel because it had eaten from the trees in the old man's garden. The slain man (the old man) did not commit aggression against the killer (the Bedouin); rather, he was killed because he was defending his garden and driving the camels out of it, and he killed its prized camel. As for anyone who aggresses against a person, their property, or their family, their blood is considered forfeit if they are killed. This is what has been stated in authentic hadiths that permit fighting the aggressor in self-defense and in defense of one's property.
