The question

What is the ruling on companies selling real estate, apartments, and offices to people before their construction, for the purpose of financing the project, with delivery after a period? And what is the ruling on trading these contracts among people (secondary market)? Does the ruling differ if the building has not been built or is under construction? And is there a difference of opinion among scholars on these issues?

The answer

The first transaction (manufacturing contract) is permissible and binding on both parties under certain conditions. It is permissible to defer or pay the price in installments, and it is permissible to include a penalty clause. As for the second transaction, there is no objection to waiving it for a price that is less than, equal to, or greater than the original price, whether construction has begun or not.
