Is it permissible to take back one's wife after a court-ordered, in-absentia divorce, given that the wife is aware of her husband's practice of sorcery and wishes to return, and that both spouses, their children, and two just witnesses were present for the recitation of Al-Fatiha?

A husband is not permitted to be absent from his wife for more than six months unless he has her permission. If the wife does not consent, she has the right to take her case to a judge, who will then contact the husband and compel him to return. If he does not return, the judge will rule for divorce or annulment.

If the judge divorces the wife due to the husband's absence, and this is the first or second divorce, the husband may remarry his wife with a new contract that fulfills the conditions, in the presence of her guardian and two just witnesses, with offer and acceptance.
