The custodian does not have the right to prevent the other party from seeing and visiting the child. The father has the right to see his daughter who is under her mother's custody, but her spending the night with him is not permissible except with her mother's consent. In the Mudawwana (Moroccan Family Code), it states: "The father has the right to visit his child with her mother, discipline her, and send her to school, but she shall not spend the night except with her mother." If a dispute arises regarding visitation, the Sharia judge shall rule on its times and place. If organizing visitation by agreement is difficult, the judge shall organize it in a place that does not psychologically harm the child.
