Is an investment company entitled to demand that an employee who has left its employ return the amounts he received as bonuses (production incentives and holiday gifts) during the last six months, even though they were spent on his family, in exchange for receiving his documents to transfer to another job?

What the company gives in gifts and grants falls into two categories:

1. If the grant is given out of benevolence, the company is not permitted to retract it, nor are the employees obliged to return it; due to the Prophet (peace and blessings be upon him) saying: "The one who retracts his gift is like the one who goes back on his vomit."

2. If the grant is intended as a reward, the giver is permitted to retract it as long as the gift itself remains and has not been consumed. However, if it has been consumed, there is no retraction.

Accordingly, the company is not permitted to retract grants that the employees have consumed.
