What is the ruling on buying a commodity with a check, given that the seller increases the price because it is with a check, and the bank takes 25 dinars for the check, and in light of the current lack of liquidity?
Whoever possesses a deed for money but cannot withdraw it due to illiquidity, this deed does not have the ruling of قبض (possession); rather, it is a debt. It is permissible to purchase any commodity with this deed that does not share the same usurious علت (underlying cause) with money, such as gold and silver. Thus, it is permissible to purchase foodstuffs, cars, houses, and the like. The resolution of the Islamic Fiqh Academy has stipulated the permissibility of selling a debt for a specific commodity or a specific tangible benefit. It does not matter that the price of the commodity for the deed holders is higher than the spot price, because the deed is a debt, and deferred sale differs from spot sale.
