Does a divorce that was conditioned upon an action take effect if that action does not occur, and what is its expiation?

1 min readAlso available in العربية

If, by a contingent divorce, the husband intended to urge his wife to travel, and the travel did not occur, the divorce takes effect according to the majority of scholars. Reconciliation is permissible before the 'iddah is complete, provided this divorce does not complete the third divorce. Pregnancy does not prevent the divorce from taking effect. Sheikh al-Islam Ibn Taymiyyah holds the view that an expiation for a broken oath (kaffarat yamin) is obligatory if the husband did not intend divorce but only intended urging.
