The majority of scholars hold that a contingent divorce takes effect upon the occurrence of the condition it is tied to, even if the husband did not intend divorce. If the divorce takes place, the husband may reconcile with his wife before her waiting period (iddah) is complete, unless this divorce completes the three divorces. Sheikh Al-Islam Ibn Taymiyyah is of the view that an expiation for a broken oath (kaffarat yameen) is due if the husband did not intend divorce, but rather intended to prevent or threaten.
