How should a husband deal with his disobedient wife who left him, denied his father's rights, prevented him from seeing his children, then sought divorce and sued him in the courts? Is her request for divorce considered khulʿ, and is he entitled to reclaim the dower and gold?

Disputes and disagreements are to be referred to the شرعي (Sharia) judiciary, or to someone mutually agreed upon by the spouses. A wife does not have the right to object to her husband spending on his parents as long as he provides for her and their children appropriately. A wife is not allowed to prevent her husband from visiting his parents or to deprive them of seeing their grandchildren; such an act is forbidden and constitutes ill-treatment. A woman is not permitted to request a divorce without a valid reason; if she does, the husband is not obliged to fulfill her request and may refuse to divorce her until she forfeits some of her rights to him. A woman is not allowed to leave her husband's house without his consent, unless there is harm or necessity; otherwise, she is considered rebellious (nashiz). If his wife becomes rebellious, the husband has the right to pursue means to encourage her to seek khul' (divorce initiated by the wife by returning Mahr or other compensation) in exchange for money, based on the Almighty’s saying: "O you who have believed, it is not lawful for you to inherit women by compulsion. And do not make difficulties for them in order to take [back] part of what you gave them unless they commit a clear immorality."
