A father is obliged to provide for his children with what is customary if they do not possess their own means of support. The mother is not obliged to provide for them unless the father is incapacitated and the child has no money. If the mother relinquishes her right and accepts one-third of the maintenance, she is not entitled to claim what she spent. However, if she does not relinquish her right, she is entitled to claim it. Maintenance is of two types: maintenance for relatives, which is waived if a person spends on himself and does not claim it, but it is not waived if he spends on another relative and wishes to reclaim it from the person upon whom it is incumbent.
