Is my marriage valid in Islamic law if it took place at the Syrian embassy with the guardian present to sign the consent, then the marriage contract was signed at the ministry in the presence of the couple and two witnesses, but without the guardian and without the recitation of the shar’i formula, and then the formula was recited over the phone between the husband and the guardian without witnesses? And if it is not valid, what should I do?

Offer and acceptance are two fundamental pillars for the validity of a marriage (nikah). The offer comes from the guardian (wali) or his agent, and the acceptance comes from the groom or his agent. The guardian must utter a phrase such as "I give you my daughter so-and-so in marriage," and the groom responds with "I accept." If there is no proper offer and acceptance, the contract must be re-executed in the presence of two witnesses. As for conducting the contract over the phone, many scholars have prohibited it due to the possibility of voice falsification, while some have permitted it if trust and security against manipulation are present. It is preferable that the contract be conducted via video conferencing applications in the presence of the parties and witnesses.
