Is it permissible for a woman to seek divorce from her husband who does not pray and drinks alcohol, especially if she does not have children with him and fears that her children might be raised in such an environment?

Habitual drinking is a major sin and a great transgression, indicating a thinness and weakness of faith. As for one who abandons prayer while acknowledging its obligation, his status is that of a transgressor (fasiq); indeed, the Sharia (definition) evidences indicate his disbelief. Associating with a transgressor and living with him is a clear harm, for the Messenger of Allah, peace and blessings be upon him, said: "There should be no harm nor reciprocating harm." For whoever is afflicted with such a situation, she should seek a divorce from him, even if it requires compensation. If he refuses, she should refer her case to the Sharia courts.
