Is the mother's custody of her children forfeited and transferred to the father because of her dishonesty with her husband's money and her confession to stealing it?

There is no disagreement among scholars that the mother has the primary right to custody of her young child, unless there is a legitimate religious impediment on her part. The majority of scholars stipulate the trustworthiness of the mother, and untrustworthiness must be proven with evidence, because the default is trustworthiness.
