Is it permissible to pay the baker a sum of money and then take the bread from him later?

It is permissible for a person to pay an advance amount to a seller, and then take bread or other items of known price and quantity from him at intervals. This is one of the permissible forms of Bay' al-Istijrar (continuous purchase) according to the Hanafis and Malikis. Ibn Abidin stipulated the permissibility of this, as long as the price is known at the time of taking, and the sale is concluded by mutual consent (al-ta'ati) when the item is taken. However, if the price is unknown, it is not permissible due to the uncertainty of the price. Some Hanafis disliked this, considering it a loan that brings benefit, while the Malikis permitted it on condition that both the commodity and the price are known.
