It is permissible to give to a person who is indebted due to his involvement in usury because he is considered among the gharimin (those in debt), and based on Sheikh Ibn Uthaymin's permissibility of giving him from zakat, distinguishing between the principal and the usurious excess. If the state waives the usurious excess, then the debtor should not be given from it. However, if the state enforces it, then he may be given from it.
