If the 'khal' (partner) is negligent in preserving the 'mudarabah' (partnership) capital and delays in transferring and securing it, he is liable for the capital and its profit if profit had appeared before his transgression and negligence. If the 'mudarib' (managing partner) transgresses and does what he is not permitted to do, he is liable for the money like a usurper. He is not asked about losses unless he transgresses against the money or is negligent in preserving it.
