The concept of a sell-or-return agreement is when a buyer purchases goods and agrees with the seller to return whatever he is unable to sell. Scholars have prohibited this type of sale due to its inclusion of jahalah (ignorance) and gharar (ambiguity/risk), which are forbidden by Sharia. Both the seller and the buyer are unaware of the quantity sold or returned. The Prophet, peace and blessings be upon him, forbade sales involving gharar. Jurists have differed on whether the sale itself is invalidated due to this condition. Alternatively, the seller can appoint the buyer as an agent to sell the goods and pay him a fee for his agency.
