"It is permissible to eat fish in any state it dies, and this is the opinion of the majority of scholars. As for the hadith narrated by Abu Dawud from Jabir bin Abdullah that the Prophet, peace and blessings be upon him, said: ""What the sea casts up or is left behind by the tide, eat it, and what dies in it and floats, do not eat it,"" it is a mauquf hadith, authentic but not marfu’. This mauquf statement is contradicted by the statement of Abu Bakr Al-Siddiq and others, and analogy requires its permissibility because it is fish that, if it died on land, would be eaten without tadhkiyah (ritual slaughter). Accordingly, fish that die in water and float are permissible as long as they do not change and cause harm, in which case their prohibition is due to the harm, not the floating.
