The majority of jurists hold that the defects which must be disclosed before marriage, and which establish the right to annulment thereafter, are those that prevent intercourse or are repulsive and contagious diseases. Some scholars, including Ibn al-Qayyim and Ibn Uthaymeen, are of the view that a defect includes anything that frustrates the purpose of marriage, such as infertility; because it prevents procreation, which is one of the most important purposes of marriage. However, if the defect is temporary and recovery is hoped for, then disclosure is not obligatory.
