Is it permissible for the questioner to adopt a fatwa that deems a divorce invalid due to obsessive-compulsive disorder (waswas), even though he asserts that he was not afflicted by waswas at the time of the divorce, knowing that he generally suffers from waswas regarding divorce?

As long as a man is afflicted with waswasah (obsessive whispering/doubts), he is permitted to adopt the easier of two scholarly opinions, and this is not considered blameworthy tarakhkhus (taking concessions). A person with waswasah may not realize he is afflicted in all cases, and often denies his waswasah regarding some issues, while in reality, he is afflicted by it concerning them.
