Is it Islamically permissible for the guardian of the girl to delegate a Sharia judge in another country to conduct the marriage without the girl's presence, provided she agrees, in order to overcome procedural difficulties in the marriage of a Kuwaiti man to a Moroccan woman?

If the father of the girl agrees and she consents to the marriage, her father can appoint whomever he wishes to عقد (solemnize) the marriage. It is not a condition for the validity of the marriage that the girl, her guardian (wali), or the husband be present. Rather, what is important is that the authorization (wakalah) comes from the legal guardian (wali shar'an).
