Does a divorce, sworn to by the husband with his words: "If you do not want my children, then you are divorced," take effect if the wife refuses to allow their drug-addicted son to live with her?

First: The husband's statement, "If you do not want my children, then you are divorced," is a contingent divorce. If he intended divorce, it occurs upon her refusal. If he only intended a threat, then an expiation for an oath is due from him. As for his statement, "If you do not want my children (I will divorce you)," this is a warning and a threat by which no divorce occurs unless by an explicit pronouncement. The husband should refer to the Sharia court or scholars to clarify his intention.

Second: The wife is not obligated to live with her husband's discerning son if his presence causes harm to her or her children, especially if he is a drug user. It is her right to refuse to live with him to avert harm.
