What are "divorce obligations," and do they differ from the alimony that has been decided, especially since there is no deferred dower, in a case of divorce before consummation?
An amicable or consensual divorce takes effect upon its issuance by the husband and cannot be revoked. A divorced woman before consummation is not entitled to maintenance unless she enabled the husband to consummate the marriage by a legal ruling, in which case she becomes entitled to maintenance from the time of enablement. If she agrees to waive maintenance, she is not permitted to claim it later. The marriage is valid if it fulfills its conditions, and its purpose being for recruitment does not affect it, though it should not be for such purposes. The presence of a deferred dowry (mu'akhkhar sadaq) is not a condition in the contract; if it exists, it is a debt owed by the husband, and a divorced woman before consummation is entitled to half of the stipulated dowry.
