What should a married woman who was married only by reciting Al-Fatiha and who has given birth to a daughter do to divorce her husband, who has refused to divorce her?

If the intention behind a man marrying a woman by reciting Al-Fatiha is that a valid Islamic marriage contract has been concluded, but it has not been documented or consummated, then the marriage is valid and the marital relationship exists. It is not permissible to propose to her or to allude to marriage with her. If she is harmed by remaining under her husband's marital bond, she may request a divorce from him, or she may refer her case to the judiciary to remove the harm.
