If a person of the Book intentionally kills a Muslim, he shall be killed in retaliation, based on the of the Jew who crushed the head of the slave girl. However, if the killing was accidental, such as in traffic accidents, then blood money (diyya) is due from the killer's 'aqila (male relatives on the father's side), in accordance with the Almighty's saying: "And whoever kills a believer by mistake - then [he must free] a believing slave and [pay] a compensation presented to his family [i.e., the family of the deceased] unless they remit it as charity." And the victim of a traffic accident is likely to be a martyr, like one who dies under rubble, but he is treated like a naturally deceased person: he is washed and prayed over.
