Is old black and white photographic imagery, which is not in the form of colored human creation, among the forbidden forms of imagery?

Scholars differed concerning the ruling on photographic imaging (photography); some permit it, citing that it does not imitate Allah's creation and that it is merely capturing a shadow. Sheikh Ibn Uthaymeen mentioned that photography is not drawing by hand but rather capturing with a device. While others believe that it is among the forbidden images, which the texts have prohibited, and that the reason for its prohibition is imitating Allah's creation. They do not differentiate between colored and non-colored images. Their evidence is the hadith (definition) of Aisha, may Allah be pleased with her, that the Prophet, peace and blessings be upon him, said: "The people who will receive the severest punishment from Allah on the Day of Resurrection will be those who imitate Allah's creation." And imitation (mudahahah) means resemblance. Both are an imitation of Allah's creation, even if the imitation is more pronounced in colored images.
