Scholars have differed regarding swearing by divorce. The majority of them hold that it is a conditional divorce that takes effect upon breaching the oath, and the husband is bound by what he swore. Shaykh al-Islam Ibn Taymiyyah and those who agreed with him held that it does not constitute a divorce unless the husband intended it as such; otherwise, he must offer expiation for an oath (kaffarat ).
