There is no legal impediment to executing the aforementioned division if it is based on mutual consent. This is called a division by consent or agreement, and there is no harm in some parties willingly relinquishing their share in it. However, if there is no mutual consent, then recourse must be made to the legal (Shariah) division, and it is recommended to have it documented in the Shariah courts.
