Is it permissible to perform Khula without the husband's knowledge, and is a marriage contracted after such Khula valid?

1 min readAlso available in العربية

A wife's travel without her husband's permission is not permissible except in cases of extreme necessity. Similarly, a khulʿ (divorce at the wife's instance) performed without the husband's knowledge or consent is invalid unless ruled by a judge.

A husband's written divorce takes effect if he intends it, regardless of whether the paper reaches the wife. If the woman married after the expiry of her iddah (waiting period), then her marriage is valid. However, if she married before the expiry of her iddah or if the divorce did not occur in the first place, then her marriage is invalid.
