Is it permissible to graze in land whose pasture has grown by rainwater, even though its ownership does not belong to the shepherd?

It is permissible to graze on pasture (kalāʾ) that is not owned by anyone. If it is on private land and its owner does not need it, then it is also permissible, and no compensation is required, due to the saying of the Prophet, peace and blessings be upon him: "People are partners in three things: water, pasture (kalāʾ), and fire." Muslims have agreed that pasture growing on unowned land (al-ard al-mubahah) is common. As for pasture on privately owned land, if its owner needs it, then he has more right to it. But if he is not in need of it, then it is permissible to take and graze it without compensation, according to the majority of scholars.
